Ruling: The Supreme Court ruled [7-2] that wearing an armband represents a form of “pure speech” that is separate from the actions connected to it. Students had the right to wear something that does not “materially and substantially” interfere with the operation of the school. This set a precedent by affirming that “a speaker has the autonomy to choose the content of his own message and, conversely, to decide what not to say." Boy Scouts of America and Monmouth Council v. Dale (2000) Question: Does the application of New Jersey's public accommodations law violate the Boy Scouts' First Amendment right of expressive association to bar homosexuals from serving as troop leaders? Ruling: The Supreme court ruled [5-4] that a state could not force the Boy Scouts to accept a gay scoutmaster because this violated their 1st Amendment right of association. This set a precedent that private organizations can refuse to allow members whose “conduct is inconsistent with the values they seek to instill. . . . [if] the presence of that person affects in a significant way the group's ability to advocate public or private viewpoints.” Burwell v. Hobby Lobby Stores (2014) Question: Does the Religious Freedom Restoration Act of 1993 allow a for-profit company to deny its employees health coverage of contraception to which the employees would otherwise be entitled based on the religious objections of the company's owners? Ruling: The Supreme Court ruled that corporations can refuse to cover birth control for their employees if it conflicts with their religious beliefs because a corporation is made up of individuals who are “using the corporation to achieve desired ends” and forcing them to pay for something that goes against their religious beliefs can be considered unconstitutional. This ruling was narrow, and the court intended it to apply to this specific situation, but it set a precedent that in certain circumstances, for-profit companies can request the same exemptions from laws on religious grounds as non-profit religious organizations. Obergefell v. Hodges (2015) Question: (1) Does the Fourteenth Amendment require a state to license a marriage between two people of the same sex? (2) Does the Fourteenth Amendment require a state to recognize a marriage between two people of the same sex that was legally licensed and performed in another state? Ruling: The Supreme Court ruled that the due process clause and the equal protection clause of the 14th Amendment protects the right to marriage and must be applied to lgbtq individuals in the same way that it is applied to straight individuals. When the national organization revoked the chapters' licenses, they filed a discrimination claim under a Minnesota anti-discrimination law. The national organization brought a lawsuit against Kathryn Roberts of the Minnesota Department of Human Rights, who was responsible for the enforcement of the anti-discrimination law. Question: Did Minnesota's attempts to enforce the anti-discrimination law violate the Jaycees' right to free association under the First Amendment? United States v. Lee (1982) Set precedent for smith standard Facts: Edwin Lee, a member of the Old Order Amish, employed several other Amish workers on his farm and in his carpentry shop. He did not pay quarterly social security taxes, and in 1978, the Internal Revenue Service (IRS) assessed $27,000 in unpaid taxes. Lee paid the portion due for the first quarter of 1973 and sued for a refund. Lee argued that the tax violated his First Amendment right to free exercise of religion. In the Amish religion, it is a sin not to provide for the community’s elderly and needy citizens. Lee argued that paying the federal government for Social Security violates that provision of his religion by giving the responsibility of caring for the elderly and needy to the government. The district court held that the Social Security tax was unconstitutional as applied. The court also noted that §1402(g) provides an exception to the social security tax for certain self employed individuals. The U.S. Supreme Court heard this case on direct appeal. He was determined to find a direct water route west of Europe to Asia, but instead he stumble upon the Americas. No one wanted to help him fund his trip. Spain- After Columbus was being turned down by England, Portugal, and France. The King of Spain Ferdinand and Queen Isabella agreed to finance his trip. Ferdinand/Isabella- They began a corporate region that would unite all the dominations of Spain and elevate the nation to a dominant world power. In 1478 introduced to Spain. Ptolemy- Claudius Ptolemy was Greco-Roman mathematician, astronomer, geographer, astrologer and a poet of a single epigram in the Greek Anthology. Hispaniola- During the 16th century Hispaniola was founded by Christopher Columbus. As Spain conquered new religions on the main land of the Americans. Cortez- A Spanish conquistador who led an expedition that cause the fall of the Aztecs Empire and bought large portions of what is now main land Mexico. Cortez was a part of generations of Spanish colonizers who began the phase of the Spanish Colonization of the Americas. Aztecs- The Aztecs, who probably originated as a nomadic tribe in the northern Mexico, arrived in Mesoamerica around the beginning of the 13th century. From there magnificent capital city Tenochtitlan, the Aztecs emerge as the dominant forced in central Mexico, developing and intricate social, political, religious and commercial organization that brought many regions city, states under control by the 15th century. Invaders led by the Spanish conquistadors Hernan Cortez, overthrew the Aztecs by forced and capture Tenochtitlan around 1521 bringing and end to Mesoamerica’s last great Civilization. Small Pox- The first documented outbreak of the small pox was in the eastern hemisphere the disease occurred in December 1518 among enslaved African miners. Small pox killed millions of natives in Mexico. In 1520 another group of Spanish arrived in Mexico from Hispaniola, bringing the small pox with them. When Cortez returned to Tenochtitlan he brought the disease with them. The small pox killed most of the Aztec Army and 25% of overall population. England- Broke with the roman church England was interested in the Americans as well. The Queen wanted to get rid of the younger sons of the aristocrats, she also wanted to get rid of the Lutherans. Elizabeth I (1558-1603)- Queen of England and Ireland from 17 November 1558, until her death on 24th March 1603. Daughter of Henry VIII and Anne Boleyn. She established the English Protestant Church, she became the Supreme Governor. The settlement was evolved into the church of England. Laws of Primogeniture- Is the right by law or custom of the paternally acknowledge, first born son to inherit his parents entire or main estate. Elizabeth didn’t want to risk her money on these new colonies. Roanoke Island- The first colony created and failed, everyone returns to England. John White- He was an English Artist and early pioneer of English efforts to settle in North America. He sailed among Richard Grenville to the shore of present day North Carolina in 1585 acting as an artist and map maker to the expedition. John gets back to England in 1587. In 1588 the Spanish tried to invade England. John White couldn’t travel back to the colony until 1590. Lost Colony- Roanoke colony was known as the lost colony; the colony was established in 1585 on Roanoke Island what is today Dave country North Carolina. Colonist disappeared during the Anglo Spanish war. Three years after the last shipment of the supplies from England. There’s no conclusive evidence as to what happened to the colonist. 1603 Queen Elizabeth dies. James I- James I is crown king in 1603, he was closest relative to Elizabeth. He was homosexual and very unsuccessful ruler. The funding of the next colony was funded by Joint Stock Company. The Virginia company was created. They sent young men to work in the land, these young men created James Town in 1607. Only a few days of settling they thought they had found real gold. Eventually no one was doing any work or preparing for the winter. From 145 to 103 to only being 38 colonists left and survived the winter. Divine right- Kings and queens have the right the god given right to rule and that rebellion against mis a sin. Joint-Stock company- A financial organization devised by English merchants around 1550 facilitated the colonization of North America. In these companies, several investors pooled their capital and received shares of stock in the enterprise in proposition to their share of the total investment. Virginia company- was a joint stock company approved by king James I to create new settlements in the colony of Virginia. A joint stock company is a business organization with which investors pooled money to purchase stock in a company. Edward Wingfield- was a soldier and a member of parliament, Jamestown (1607)- King James the I granted to the Virginia Company of London all the lands stretching from present-day North Carolina to southern New York. It was an all-male group with no ability to support itself. Farmers or ministers were among the first arrivals, they were expected to extract tribute form the religions of the Indians population while they search for valuable commodities like pearls and gold. There was no gold and the men failed poorly in the new environment. They lacked access to water, they refused to plant crops, and quickly died off only 38 of the 120 were left alive during the nine months. By 1611 the Virginia company send out 1,200 colonists to Jamestown and only fewer than half of the population survived. John Smith- He was a trouble maker and was sent to oversee James Town. Eventually no one liked John because he made everyone work. Powhatan- was the paramount chief of Tsenacommacah, an alliance of Algonquian-speaking Virginia Indians in the Tidewater region of Virginia at the time English settlers landed at Jamestown in 1607. Pocahontas- Pocahontas was a Native American woman notable for her association with the colonial settlement at Jamestown, Virginia. She married John Rolfe. DeLaWarr- Lord De La Warr was appointed governor-for-life and captain-general of the Colony of Virginia, to replace the governing council of the colony under the presidency of Captain John Smith. Subsequently, in November 1609, the Powhatan tribe of Native Americans killed John Ratcliffe, the Jamestown Colony's Council President, and attacked the colony in what became the First Anglo-Powhatan War. Rolfe- was one of the early English settlers of North America. He is credited with the first successful cultivation of tobacco as an export crop in the Colony of Virginia. Rolfe married Pocahontas, daughter of the local Native American leader Powhatan, on 5 April 1614. Tobacco- The native tobacco from Virginia was not liked by the English settlers, nor did it appeal to the market in England. However, Rolfe wanted to introduce sweeter strains from Trinidad, using the hard-to-obtain Spanish seeds he brought with him. In 1611, Rolfe was the first to commercially cultivate Nicotiana tabacum tobacco plants in North America; export of this sweeter tobacco beginning in 1612 helped turn the Virginia Colony into a profitable venture. Rolfe named his Virginia-grown strain of the tobacco "Orinoco", possibly in honor of tobacco popularizer Sir Walter Raleigh's expeditions in the 1580s up the Orinoco River in Guiana in search of the legendary City of Gold, El Dorado. The appeal of Orinoco tobacco was in its nicotine, and the conviviality of its use in social situations. In 1612, Rolfe established Varina Farms, a plantation along the James River about 30 miles (50 km) upstream from Jamestown, and across the river from Sir Thomas Dale's progressive development at Henricus. The first harvest of four barrels of tobacco leaf was exported from Virginia to England in March 1614, and soon, Rolfe and others were exporting vast quantities of the new cash crop. New plantations began growing along the James River, where export shipments could use wharfs along the river. Opechanough- Opechancanough was a war-chief of Tsenacommacah, a political alliance of Algonquian-speaking Virginia Indians, who famously led assaults against the English settlers in 1622 and 1644. He was the younger brother (or cousin) of Powhatan, the paramount chief famous for his relations with the English at the time of their arrival in Virginia in 1607. Known for his leadership and military prowess, Opechancanough’s favor and fortune rose as that of his brother diminished in the years following hostilities with the English during the First Anglo-Powhatan War (1609-1614). At some point before the arrival of the English, Powhatan likely designated Opechancanough as werowance, or chief, of the Youghtanund Indians and later the head of the adjacent Pamunkey tribe. This appointment made him the military leader of one of the most critical Powhatan territories, a position that served him well during his later military conflicts with the expanding English settlements. Headrights- is a legal grant of land to settlers. Headrights are most notable for their role in the expansion of the thirteen British colonies in North America; the Virginia Company of London gave headrights to settlers, and the Plymouth Company followed suit. Puritans- Separating puritans thought the Roman church was rotten and wanted to separate. Most puritans were non-separating puritans and wanted to fix the church. In the New England church if you wanted to become a puritan you had to follow a ritual. 1620’s people who were puritans were being executed. 1630 Puritans migrated to Virginia. John Winthrop wanted a city on a hill and he expected the people to build a religious community, he wanted people back in England to adapt to their new religious practices.
